The Competition Commission of India (CCI) has taken a significant step towards understanding the impact of emerging technologies such as artificial intelligence (AI) on the goods and services markets. The regulator has initiated a market study on “artificial intelligence and competition in India” to assess the competition-related aspects within AI ecosystems.
The proposed study aims to delve into the potential risks and benefits of AI, particularly in terms of efficiency and innovation in key industries. By gathering data from various stakeholders including technology firms, start-ups, and industry associations, the CCI hopes to gain a comprehensive understanding of the evolving competition dynamics in AI development ecosystems.
Experts have lauded the CCI’s proactive approach towards addressing the challenges posed by AI in digital markets. M M Sharma, head of competition law at Vaish Associates Advocates, emphasized the importance of conducting such a study at a time when new technologies are still in their early stages.
The CCI has set a deadline of June 3 for submitting bids for the study, with financial bids to be opened on June 28. The proposed methodology includes collating existing research, conducting surveys and interviews with key stakeholders, and compiling and analyzing the gathered information. The nominated agency will be required to submit an interim report before presenting the final findings to the CCI.
This market study is part of the CCI’s broader efforts to enhance its capabilities in the technology sector. In 2023, the regulator established an in-house digital markets and data unit, and more recently, it introduced the draft Digital Competition Bill 2024 to regulate big tech firms in India. The CCI’s proactive stance towards understanding and regulating the impact of AI reflects its commitment to fostering innovation and fair competition in the digital age.
